A BILL to amend and reenact section three, article one, chapter
twenty of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to continuing the
parks section and parks functions of the division of natural
resources until the first day of July, one thousand nine
hundred ninety-seven.
Be it enacted by the Legislature of West Virginia:
That section three, article one, chapter twenty of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 1. ORGANIZATION AND ADMINISTRATION.
§20-1-3. Division of natural resources, office of director and commission established; termination date for
division
of natural resources and for parks section
of division
of natural resources.
A division of natural resources, the office of director of
the division of natural resources and a natural resources
commission are hereby created and established in the state
government with jurisdiction, powers, functions, services and
enforcement processes as provided in this chapter and elsewhere
by law.
Pursuant to the provisions of article ten, chapter four of
this code, the division of natural resources shall continue to
exist until the first day of July, two thousand one.
Pursuant to the provisions of article ten, chapter four of
this code, the parks section and parks functions of the division
of natural resources, transferred to the division of natural
resources pursuant to the provisions of section twelve, article
one, chapter five-b of this code, shall continue to exist within
the division of natural resources until the first day of July,
one thousand nine hundred ninety-six ninety-seven, to allow for
monitoring of compliance with recommendations contained in the preliminary performance review and to allow for further review by
the joint committee on government operations.

(NOTE: The purpose of this bill is to continue the parks
section and parks functions of DNR until July 1, 1997, to allow
for monitoring of compliance with recommendations contained in
the preliminary performance review and to allow for further
review by the Joint Committee on Government Operations pursuant
to the West Virginia Sunset Law.

This bill is recommended by the Joint Committee on
Government Operations for passage during the 1996 regular session
of the Legislature.)
